In India, a registered design is a form of intellectual property that protects the aesthetic or ornamental aspects of an article. The legal framework is provided by The Designs Act, 2000 and the corresponding Designs Rules, 2001.
A "design" refers to specific visual features applied to an article — whether in two-dimensional or three-dimensional form — by any industrial process or means. The critical requirement is that these features must appeal to the eye and be judged solely by their visual appearance. They cannot be purely functional.
The design must be new and original — not previously published in any country or used in the public domain before the application date. Notably, an "original" design can include one that is old in itself but new in its application to a particular article.
The design must be visually appealing and not merely a functional component of the article. Protection is granted for aesthetics, not mechanics — the design must have an ornamental character that distinguishes it visually.
The design must be applied to an article that is capable of being manufactured through an industrial process. This requirement ensures design protection is commercially relevant and practically applicable.
The design must not be contrary to public order or morality, or contain scandalous or obscene matter. It also cannot be a mere mechanical device or a trademark, which are protected under separate legislation.
The Act explicitly excludes the following from design protection:
A registered design grants the proprietor legal "copyright" over the design — the exclusive right to apply it to the article for which it is registered.
The initial 10-year registration can be extended for one additional period of 5 years — providing a maximum of 15 years of protection in total.
Registration gives the owner the right to take legal action against any person who fraudulently imitates, copies, or applies the design without permission — referred to as "piracy of a registered design."
